DCLG: A New Mandatory Power of Possession for Anti-Social Behaviour

Details were given of a Department for Communities and Local Government consultation paper 'A new mandatory power of possession for anti-social behaviour' which sought views on six specific questions. Consideration was given to a draft response to the consultation.
Concern was expressed that the consultation paper assumed all anti-social behaviour occurred within the tenanted sector and eviction could result in consequential damage to vulnerable third parties. It was considered that the proposed measures should be applied as part of a comprehensive inter-agency approach to addressing anti-social behaviour and there was disquiet about the funding cuts to Community Safety Partnerships.

The Cabinet resolved that the draft response to the consultation set out at Annex 1 to the report be approved subject to the additional concerns expressed at the meeting and summarised above, and the final response be agreed in consultation with the Leader and Cabinet Member for Housing.
